Repetitive Strain Injury Claims, Northern Ireland
A repetitive strain injury (RSI) — sometimes called overuse syndrome or upper limb disorder— is the pain and discomfort caused by repeating the same movements over a long period. It usually affects muscles, tendons, joints and nerves in your arms, shoulders, wrists and hands.
If you’re living with a repetitive strain injury, you may be experiencing long-term pain, loss of strength and other symptoms that impact your life every day. When your RSI is the result of your employer’s failure to properly protect you, you are entitled to compensation. Our specialist RSI solicitors are here to help you claim the money that’s rightfully yours.
Symptoms & Causes of Repetitive Strain Injury
Repetitive strain injuries result in a wide variety of different symptoms, depending on the action that caused the RSI. These symptoms can range from mild to severe. Common types of RSI include:
- Carpal Tunnel Syndrome – Tingling, numbness, pain or weakness caused by putting pressure on a nerve in your wrist. This is the result of repeatedly putting your wrist in an unnatural position.
- Tennis Elbow – Pain and tenderness around your elbow and forearm. This is due to repeated heavy lifting, use of heavy tools, squeezing, twisting or any other repeated movement when your arm is in an awkward position.
- Vibration White Finger – Permanent, painful numbness and loss of strength caused by regular exposure to hand-arm vibration from hand-held power tools.
- Bursitis – Painful swelling around a joint. This is usually caused by putting too much pressure on a joint, such as by kneeling for long periods.
- Tendonitis – Swollen tendons causing joint pain, stiffness and mobility problems. It is typically caused by repetitive movements or poor posture that damage a tendon.
- Dupuytren’s Contracture – Condition in which one or more fingers bend towards the palm of the hand. It is linked to repeated vibrations from tools and machinery.
- Frozen Shoulder – Pain and stiffness in the shoulder. This can be the result of injuries to tendons and muscles in your shoulder or from having to keep your shoulder still for a long time.
RSI Claim Eligibility
Your employer has a duty of care to you. If they failed to provide a safe working environment and this resulted in you sustaining an RSI, you are eligible to make a repetitive strain injury claim.
Claiming for Yourself – If you’ve suffered an RSI as a result of employer negligence, you can make an RSI claim.
Claiming on Behalf of Someone Else – If a loved one suffered an RSI due to employer negligence and is unable to make a claim, you can claim on their behalf.
RSI Claim Process
We understand that the aches and pains of a repetitive strain injury have a significant impact on your life. That’s why we’ve created an RSI claim process that avoids placing any extra burden on you — we handle everything. Here’s what to expect.
Step 1: Contact Reid Black
Make the all-important first step of getting in touch for free initial legal advice on your RSI claim. There’s no obligation to proceed.
Step 2: Gathering Information
If you decide to proceed with your claim, we’ll start gathering as much evidence as possible to support it. This will include things like information about your work history and your medical records.
Step 3: Medical Assessment
We’ll then arrange for you to be assessed by an independent medical professional. We want to be 100% certain of the long-term impact of your RSI before seeking compensation.
Step 4: Compensation Negotiations
Once we’re sure of the prognosis and any lasting effects of your injuries, we will negotiate with your employer’s insurance company to secure the maximum compensation to which you’re entitled.
Step 5: Compensation Payout
We continue to represent your interests to make sure the insurer pays the compensation in a timely manner.
Repetitive Strain Injury Claim Time Limits
You usually have three years from the injury starting or being diagnosed in which to make an RSI claim in Northern Ireland. This can be extended in exceptional circumstances, such as if your employer’s negligence only becomes known later.
In all cases, it’s always best to get in touch with us as soon as you become aware you have an RSI.
RSI Compensation Payouts
The amount of RSI compensation you get will depend on how serious the injury is. Factors such as the level of pain you’re enduring, the impact on your quality of life and your career will be taken into consideration.
The payout you receive will be split into two types of compensation – General Damages and Special Damages.
General Damages
This is compensation for the direct impact the RSI has had on your life, the amount of pain and discomfort you’re in, and how long that pain will last. General damages compensation payouts for RSI claims in Northern Ireland are set according to the following guidelines:
Up to £12,000 if you will make a complete recovery from your RSI within a short period.
£12,500 – £17,500 if your RSI symptoms will resolve within two years.
£22,500 – £40,000 if you’ll experience continuing RSI symptoms.
£30,000 – £60,000 if you’ll experience continuing disability and loss of employment.
Special Damages
This is compensation that reflects the financial impact of your RSI. It will cover things like medical fees, travel expenses, rehabilitation costs and loss of earnings. Compensation amounts for special damages will vary depending on your individual circumstances.
