There are a variety of different causes of amputation and the loss of limbs that lead to amputation claims. We’ve mentioned some of them already but let’s take a closer look at some of the main reasons for an amputation.

Your employer has a duty of care to keep you safe and minimise the risk of amputation due to accidents at work. Providing inadequate safety training, failing to put in place the correct health and safety procedures, and having poorly maintained or unsuitable equipment can result in amputation injuries. You could make an amputation claim if:

  • Your fingers, hand or arm had to be amputated because the machine you were using didn’t have the correct safety guard.
  • Your foot or leg had to be amputated because it was crushed when dangerously stacked items fell on it.
  • Your toe had to be amputated because your employer didn’t provide steel toe-capped boots when you were working with a chainsaw.
Motorists — and especially more vulnerable road users such as cyclists, motorcyclists and pedestrians — can suffer amputation injuries in road traffic accidents. You can claim if the accident was someone else’s fault because they were:

  • Speeding, driving aggressively or failing to follow the Highway Code correctly.
  • Driving under the influence of alcohol or drugs.
  • Distracted by a mobile phone, radio or satnav.
When visiting public places, you’re reliant on the business or landowner putting in place measures to keep you safe. If they don’t and you suffer an injury that leads to you losing a limb, you’re eligible to make an amputation claim. For example:

  • You suffered a crush injury because signage or building materials fell on you.
  • A limb was crushed or severed by dangerous or poorly maintained play or leisure equipment.
  • You suffered traumatic injuries in a fire, explosion or other disaster.
Surgical amputations are sometimes unavoidable. But they may be the result of medical negligence if a doctor has failed in their duty of care to you. You can make an amputation claim for medical negligence if your amputation was due to:

  • Mistakes and avoidable damage caused during surgery
  • Misdiagnosis or failure to read X-ray results correctly
  • Incorrect, inadequate or delayed treatment

Amputation Claim Eligibility

Anyone who has lost a limb in an accident that wasn’t their fault is entitled to make an amputation claim in Northern Ireland. You can claim for yourself or on behalf of a friend or family member.

Claiming for Yourself – You are eligible to claim amputation compensation if you’ve undergone an amputation because of someone else’s negligence.

Amputation Claim Process

Amputation Claim Time Limits

You usually have three years from the date of your operation in which to make an amputation claim in Northern Ireland. The exceptions to this time limit are:

  • If you were under 18 at the time of your amputation, you can claim up to your 21st birthday.
  • If you or the person you’re claiming for was unable to make a claim during the usual timeframe because they suffered brain damage or were mentally incapacitated in another way.

Amputation Compensation

If you’ve lost a limb, it’s important to claim amputation compensation that reflects the pain and hardship you’re enduring as well as the physical and psychological impact of your injury.

Compensation can help you to address the seen and unseen effects of amputation, and put plans in place that safeguard you and your loved ones for the future. Compensation is split into general damages and special damages.

General Damages Compensation

General damages means the compensation you’re entitled to for the direct impact of losing a limb. This includes the pain and suffering caused by the circumstances of the amputation, any ongoing and phantom pain you’re experiencing, and the overall impact the amputation has had on your quality of life.

Below you will see examples of compensation amounts you could receive in Northern Ireland if you’ve suffered an amputation. Please note these amounts are guidelines only, and your total compensation will be based on the severity of your amputation:

  • Arms – £90,000 to £600,000
  • Hands – £85,000 to £425,000
  • Fingers – up to £140,000
  • Legs – £140,000 to £400,000
  • Feet – £30,000 to £400,000

Special Damages Compensation

Special damages are awarded for financial hardship and expenses you’ve experienced because of your amputation. It covers things like:

  • Loss of Employment & Earnings – You don’t have to suffer financially if you can no longer work or your income has dropped following an amputation. You can claim for earnings you’ve already lost as well as future earnings and pensions. You can also claim lost earnings on behalf of a loved one whose employment has been impacted by your amputation.
  • Rehabilitation & Medical Costs – Amputations often result in long-term or even lifelong physio appointments, occupational therapy and medical treatments. You can claim for the past, ongoing and future costs of your recovery.
  • Adaptations to Your Life – This might include prosthetics, adaptations and aids around the home, and even moving house. You can claim for the changes you need to make to secure the quality of life you deserve.

      What a fantastic group of people to work with from start to finish.
