Pedestrian Car Accident Claims, Northern Ireland
More than 600 pedestrians in Northern Ireland are killed or injured every year as a result of road traffic accidents — almost two a day. That worrying statistic highlights how vulnerable you are to the actions of drivers when travelling on foot.
If you’re a pedestrian who has been struck by a vehicle while walking alongside Northern Ireland’s roads, you could be entitled to compensation for any injuries suffered. Whether you’ve been hit by a car, bus, motorcycle or bicycle, we can help you claim the maximum amount for which you’re eligible.
Pedestrian Injuries
When a person with no protection around them is struck by a vehicle, injuries will inevitably happen. How serious those injuries are depends on the circumstances of the collision and the speed at which the vehicle was travelling.
Common Injuries:
Slight – Bruising, sprains, strains, minor cuts and whiplash.
Less Serious – Fractured limbs or collarbone, deep cuts and minor head injuries.
Moderately Serious – Fractured thigh or pelvis, chest injuries, partial loss of a limb and deeply penetrating wounds.
Very Serious – Broken neck or spine, severe head or chest injuries, and internal injuries.
Who can make a Pedestrian Accident Claim?
If you are a pedestrian who was injured in a collision with a vehicle through no fault of your own, you are eligible to claim compensation. If you’re the loved one of someone who was injured in those circumstances and unable to make a claim, you can claim on their behalf.
But pedestrians cannot claim if they are deemed to be at fault for an accident. Examples of this include failing to look properly before crossing a road; acting carelessly, recklessly or being in a hurry; crossing the road when drivers can’t see you because of a stationary or parked vehicle; and wearing dark clothing at night.
If you’re unsure who was at fault for your accident, one of our experienced solicitors can advise you whether you have a claim in a free, no-obligation consultation.
Pedestrian Accident Claim Process
Pedestrian accidents can be traumatic and often life-changing events. We’ve designed our claim process to be as simple and straightforward so you can get the compensation you’re entitled to without extra stress.
Step 1: Contact Reid Black
The first step is to get in touch for free legal advice on your pedestrian accident claim. Talk to one of our solicitors before deciding how to proceed.
Step 2: Gathering Information
Once you give us the go-ahead, our solicitors will start gathering all the information we need to support your claim. This might include medical notes, any dashcam footage from the scene and police reports.
Step 3: Medical Assessment
We will then arrange for you to be assessed by a medical professional. You can only claim for your injuries once so we want to be certain that nothing has been overlooked before making your claim.
Step 4: Compensation Negotiations
All of the negotiations will be handled by our solicitors, who are experts in road traffic claims. We will work to secure the maximum amount due to you from the driver’s insurance company.
Step 5: Compensation Payout
Once a settlement figure is reached, we will continue to represent you to ensure the payout reaches your account promptly and you can move forward with the rest of your life.
Time Limits for making a Pedestrian Accident Claim
You normally have three years after being struck by a vehicle to make a pedestrian accident claim.
- For pedestrians aged 18 or over at the time of the accident, the claim must be made within three years.
- For pedestrians aged under at the time of the accident, the claim must be made by your 21st birthday.
These deadlines may be extended if there are mitigating circumstances, like your injuries preventing you from making a claim. The safest option is to get in touch to start your claim as soon as you are fit to do so.
Pedestrian Accident Compensation – How much can I claim?
The amount of compensation for pedestrian accidents depends on the amount of pain and suffering you’ve endured and the long-term impact of your injuries on your physical and mental health, as well as your finances.
General Damages: Compensation awarded based on the seriousness of your injuries and their impact on your life.
Special Damages: Compensation awarded to cover the expenses you’ve incurred because of the accident, such as travel costs, medical fees and loss of earnings.
