Civil Claims Against the MOD
Making a civil military claim against the MOD is similar to claiming against any other employer. The claim will be made through the civil courts and we’ll need to show that the MOD was at fault for your injury.
Civil claims against the MOD typically result in significantly higher payouts than military compensation schemes, which are managed by the MOD and awarded based on tariffs rather than the full impact of your injury on your life. For that reason, a civil claim against the MOD is always our preferred option.
Claims Under the Armed Forces Compensation Scheme
The Armed Forces Compensation Scheme (AFCS) is managed by the MOD. It is open to anyone who has been injured while serving, so you don’t need to show that the MOD was at fault for your injuries. It covers injuries sustained during operations, training, service-approved sports and exercise.
Compensation is awarded based on a tariff and is usually lower than for civil claims. It will not factor in financial losses and other consequences of your injury. But an AFCS claim is a useful alternative if you are not eligible to make a legal claim.
Claims Under the War Pension Scheme
The War Pension Scheme is a compensation scheme for injury, illness or death caused by serving in the armed forces before 6 April 2005. You don’t need to show the MOD was at fault for your injury. The scheme is open to anyone whose injury was suffered before that date and who is no longer serving.
Depending on the seriousness of your injuries you’ll either receive a lump sum payment or an ongoing pension payment. Unlike civil claims, there isn’t usually a time limit for claiming compensation.

Military Injury Claim Time Limits
The time limit for making a civil military injury claim in the UK and Northern Ireland is three years from the date of your injury. There are some exceptions to this:
- If you were under 18 at the time of your injury, you can claim up to your 21st birthday.
- If you or the person you’re claiming for don’t have the mental capacity to make a claim, there are no time limits.
There is a seven-year time limit for AFCS claims and no time limit for WPS claims. In all cases, we recommend starting your claim as soon as possible.
