What is Hospital Negligence?

Hospital Negligence Claims

Causes of Hospital Negligence

Hospital negligence within NHS Trusts and private hospitals stem from various issues and can often be traced back to systemic problems within our healthcare system.

A nurse might administer the wrong medication due to unclear instructions, whereas a doctor might misdiagnose a condition because they’re overworked and lack adequate time for patient evaluation. Surgical errors can happen due to miscommunication in the operating theatre, while hospital-acquired MRSA infections often result from poor hygiene practices.

Many of these causes are avoidable. Proper training, communication and adherence to protocols can significantly reduce hospital negligence cases.

By making a hospital negligence claim, you not only seek compensation for your suffering but you also help highlight these systemic issues within our hospitals. Your successful claim could lead to positive changes for better standards of care, reducing the risk of similar incidents occurring in the future.

Hospital Negligence Claim Eligibility

In the UK and Northern Ireland, you may be eligible to make a hospital negligence claim if you have suffered harm due to substandard care provided by a hospital. To bring a claim, you must meet certain criteria.

Firstly, you must show that the hospital or healthcare professional breached their duty of care, and that this breach directly caused harm or injury. Secondly, generally you must start your claim within three years from the date of the incident, or from when you became aware of the negligence.

  • Claiming on Behalf of Yourself – You can make a claim if you have personally experienced harm due to hospital negligence.
  • Claiming on Behalf of Another Person – You can make a claim on behalf of a loved one who cannot do so themselves, such as a child, someone with mental incapacity, or an individual who has passed away due to negligence.

Death by Hospital Negligence

Losing a loved one due to hospital negligence is a devastating experience, and we understand that making a claim may not be your priority during such an emotional time. The grief can be overwhelming, and dealing with legal matters might feel impossible.

However, if your loved one’s death was avoidable or caused by negligence, you may have the chance to make a claim. This can provide acknowledgment of substandard care, a sense of justice, and financial compensation to help with associated costs.

When you feel ready, please contact us. Our team is here to support you and ensure your case is handled with care and sensitivity.

Frequently Asked Questions

No win, no fee arrangements are not permitted in Northern Ireland. However we offer alternative funding options and advice on Legal Aid eligibility, to help you pursue your hospital negligence claim.
In the UK and Northern Ireland, the time limit for making a hospital negligence claim is generally three years from the date of the incident or from when you became aware of the negligence. This is known as the “date of knowledge.”

There are exceptions for minors, where the three-year period starts when they turn 18, and for individuals who lack mental capacity. It’s important to seek legal advice as soon as possible to ensure your claim is filed within the appropriate time frame.

Generally, straightforward cases may take 12 to 24 months to resolve, while more complex cases can take several years. Factors influencing the timeline include the complexity of the medical issues, the availability of medical records, the need for expert opinions, and whether the hospital admits liability.
Yes, you can make a hospital negligence claim even if you are still receiving treatment. Ongoing treatment does not prevent you from pursuing a claim. In fact, it’s important to start the claims process as soon as possible to ensure that all necessary evidence and medical records are collected in a timely manner.
Yes, there are differences in claiming against an NHS Trust compared to a private hospital.

NHS Hospital Claims are made against the NHS Trust responsible for the hospital. A formal complaints procedure must be followed first, and Legal Aid may be available depending on your circumstances.

Private Hospital Claims are made against the individual hospital or healthcare provider. These claims are based on a contractual relationship, and Legal Aid is generally not available.

Our experienced solicitors can guide you through the specifics of making a claim against either type of hospital. Contact us to discuss your case.

What a fantastic group of people to work with from start to finish. I thoroughly endorse this firm of solicitors to any former service personnel who have suffered hearing loss and/or tinnitus as a result of live firing in pipe ranges in Northern Ireland. These guys acted on my behalf following a simple hearing assessment and secured a sizeable settlement from the MoD for me. They did not take ANY of my compensation in payment, but claim a separate payment directly from the MoD for their work. David even declined an initial derisory offer from the MoD and secured a much better one which was 500% (yes 500%) above the original offer. If you or you know anyone who suffers the same problems, I would urge you to get in touch with David French or one of his colleagues at Reid Black solicitors. The only downside is the amount of time you have to wait for the MoD to play ball. On the plus side you’ll probably forget you’ve claimed at all and so it’s a great surprise when you finally get a result!read more

I am absolutely delighted at the result David French and the whole team at Reid Black managed to negotiate for my hearing loss claim. It was a long process, but none of that due to RB, rather the bureaucracy and feet dragging of the MoD. There was one small period of frustration on my part when I had not heard from them in a while, but it transpired that their communications with me via e-mail had gone into my spam box, that I don't regularly check, so this frustration was my fault completely. David received an initial settlement offer, but refused it and negotiated a 33% increase in the offer on my behalf. I thoroughly recommend this Business to any former service personnel that served in NI after 1987, that have suffered hearing injuries. Thank you Reid Black.read more

A Separation of a marriage is a really devasting and stressful time. My daughter used the services of Kathryn Aiken. Kathryn is such a lovely lady, with a real kindness and total understanding of the situation. She gave my daughter excellent legal advice and guided us safely through the whole process. Yes it did take time to finally come to an agreement on matters, but all throughout Kathryn was available to answer emails promptly or take a phone call. Nothing was ever a bother. That means a lot to have that total backing and support. We felt totally at ease meeting Kathryn at her office to sign documents and as upsetting as it sometimes was we were shown total empathy and comforted on occasions were needed. The quotation Kathryn gave me at the start of the process was near enough spot on at the end. I would not hesitate to recommend Kathryn to anyone in need of help. you are 100% in the best professional hands. I will be using Kathryn again in the future. Thank you for everything. Ref - Military hearing loss claim. I am speechless - having left the Army 32 years ago I never expected to qualify for any sort of payout. Getting in touch with Reid Black Solicitors was more a case of - 'try it and see, nothing ventured, nothing gained.' Absolutely dumbfounded by the amount you have recovered for me. I never expected any payout to be in the 5 figure bracket. We have a modest income and lead a modest lifestyle, but now, all our current financial challenges are over. A 'Thank you' seems totally inadequate, but we are truly grateful for your efforts and the result. Thank you. Kind Regards Alan Munceread more
