Mrs C from Limavady has received £11,343.75 in compensation after making a hearing loss claim against Desmond & Sons.

  • Mrs C was employed by Desmond & Sons Clothing Factory as a machinist for 10 years.
  • Mrs C noticed difficulty hearing family and friends in loud social situations and also an occasional ringing noise in her ears.
  • We were contacted to pursue a Noise Induced Hearing Loss Claim.
  • Mrs C was awarded £11,343.75 in compensation for her hearing loss and tinnitus.

The Case

Mrs C began working in a clothing factory after she left school, where she was exposed to noise from sewing machines, overlockers and other loud production machinery. Whilst this exposure occurred daily, for over 40 hours per week, Mrs C was never provided with any form of hearing protection by Desmond & Sons. The prolonged period of exposure, without any sufficient protection, has had a long-lasting impact on Mrs C hearing.

The Claim

After hearing about Noise Induced Hearing Loss Claims from former colleagues, Mrs C began to suspect that the cause of her hearing problems could be linked to her previous employment with Desmond & Sons. She therefore got in touch with us after recommendations from family and friends.

On Mrs C’s behalf, our solicitor Danielle Catterson began to compile the evidence in order to present a claim to Desmond & Sons insurers.

After obtaining relevant employment and medical records, we arranged for Mrs C to be examined by an ENT consultant, who ultimately concluded that the entirety of Mrs C hearing problems and tinnitus were caused as a result of her noise exposure within Desmond & Sons factory.

The Settlement

Following a period of discussions with the insurers, we had to issue legal proceedings. Once all relevant medical evidence was served on the appointed legal team, we entered negotiations to obtain Mrs C the compensation she deserved.

After negotiations by Danielle, Mrs C was offered compensation in the sum of £11,343.75, a result which she was delighted with.
