Miss K from Dungiven has been awarded £13,700 in compensation after making a hearing loss claim against Desmond & Sons.
- Miss K was employed by Desmond & Sons as a machinist for 8 years.
- Miss K noticed her hearing had deteriorated and wondered if the noise exposure had any impact on this.
- We were contacted to pursue a Noise Induced Hearing Loss Claim.
- Miss K was awarded £13,700 in compensation for her hearing loss and tinnitus.
The Case
Miss K began working in Desmond & Sons factory in Dungiven when she was 17. She was employed as a machinist and was responsible for operating sewing machines, 40 hours per week. Despite the elevated noise levels, Miss K’s employers never provided her with any form of hearing protection.
The Claim
Miss K contacted Reid Black Solicitors after realising that noise exposure could have had a part to play in her hearing difficulties.
Once we obtained relevant medical and employment records, our Solicitor Danielle Catterson arranged for Miss K to be examined by an ENT consultant and after undergoing a hearing test, it was concluded that Miss K’s hearing loss was because of the noise exposure in Desmond & Sons.
The Settlement
The medical report confirming Miss K’s noise induced hearing loss was served on Desmond & Son’s insurers, and their appointed solicitors ultimately obtained their own medical, which agreed that the noise did in fact cause damage to Miss K’s hearing.
Given these conclusions, Danielle entered into settlement negotiations. Miss K received £13,700 in compensation, with her legal costs also being covered.
