Uninsured Driver Accidents in Northern Ireland
We know that being hit by an uninsured driver is an awful experience. In addition to the physical and psychological injuries that can be caused in any road traffic incident, you suffer additional hardship because the other driver wasn’t abiding by the laws the rest of us follow.
Almost 7,000 uninsured drivers were stopped by the PSNI in 2021 and many more will have gone undetected. That means collisions involving uninsured drivers and stolen vehicles are all too common on our roads. Fortunately, even if you’re involved in a collision in which the other driver didn’t have insurance, you can still claim the compensation you deserve.
Uninsured Driver Accident Injuries
Uninsured drivers inflict a wide variety of injuries as a result of their actions. Common injuries caused by uninsured drivers include:
- Slight injuries such as whiplash, minor cuts, bruises and shock.
- Less serious injuries, such as minor head injuries, fractured arms, legs or collarbone, and deep cuts.
- Moderately serious injuries such as thigh and pelvis fractures, chest injuries and deeply penetrating wounds.
- Very serious injuries such as severe head or chest injuries, broken neck or spine, and internal injuries.
In the most serious cases, a fatal uninsured driver accident may result in the loss of life.
Who can make an uninsured driver accident claim?
Anyone who was injured by an uninsured driver or a stolen vehicle is eligible to make an uninsured driver accident claim. This includes drivers, passengers, pedestrians, cyclists and motorcyclists.
You can also claim on behalf of a loved one who was involved in an uninsured driver accident but is unable to make their own claim.
Notable exceptions to these criteria are passengers injured while travelling in a vehicle that they know is stolen or with a driver they know is not insured. A claim cannot be made in these circumstances.
Motor Insurers’ Bureau (MIB)
Uninsured driver accident claims are brought against the Motor Insurers’ Bureau (MIB). This is a not-for-profit organisation funded by the insurance industry to ensure the victims of uninsured drivers are compensated for their injuries.
The MIB’s Uninsured Drivers Scheme pays compensation to those involved in accidents involving uninsured drivers through no fault of their own. You claim from the MIB in the same way you would a specific insurance company in other road traffic accident claims.
Uninsured Driver Accident Claim Process

Time Limits for Claiming Against an Uninsured Driver
You usually have three years after an accident involving an uninsured driver in which to make a claim. This varies slightly depending on your age at the time of the accident:
- If you were aged 18 or over you must claim within three years of the date of the accident
- If you were aged under 18 at the time of the accident, you need to claim before your 21st birthday
Exceptions to these rules may be granted if you can show that you were unable to claim within three years. For example, your injuries might have prevented you from claiming until a later date.

The good news is that you’re entitled to the same level of compensation as if you had been involved in any other road traffic accident.

This is compensation for the physical and psychological injuries caused by the uninsured driver.
