The Case
Following a lengthy employment with the Council, Mr B began to notice a deterioration in his hearing, alongside a high-pitched buzzing noise in his ears that affected him 7 nights per week. For the first 30 years of his employment, Mr B was not given any hearing protection, despite operating noisy machinery and equipment every day.
The Claim
After noticing difficulties with his hearing, Mr B believed that it was his long period of exposure to excessive noise levels that led him to suffer from hearing loss and tinnitus. Mr B therefore contacted us to discuss pursuing a claim for compensation.
Danielle Catterson was instructed to act on behalf of Mr B and arranged for an ENT consultant to examine him, so that the extent of his hearing loss and tinnitus could be explored in full. It was concluded by the ENT consultant that Mr B was suffering from permanent hearing loss and tinnitus.
The Settlement
Once we were in receipt of the medical report, we ultimately had to issue legal proceedings and the Council’s legal team thereafter sought medical evidence from their own appointed expert. After some lengthy discussions, the Council ultimately increased their settlement offer, and our client was happy to receive a cheque for £25,000 in damages.
