Accident at Work Claim Time Limits
The time limit for workplace accident claims in Northern Ireland is usually three years. This may be extended in some circumstances:
Claiming for Yourself – If your diagnosis or information showing employer negligence comes to light outside the normal time limit, you have three years from the date you received the information.
Claiming on Behalf of Someone Else – If you are claiming on behalf of someone aged under 18 at the time of the accident, you can claim up to their 21st birthday. If you are claiming on behalf of someone who has a mental incapacity, there is no time limit for as long as they are incapable of claiming.
If you are claiming on behalf of a loved one who lost their life in a workplace fatality, you must claim within three years of the accident or within three years of a post-mortem confirming their cause of death.
