Slip, Trip & Fall Claims, Northern Ireland
More than 10,000 people suffer serious injuries because of slips, trips and falls in Northern Ireland’s workplaces each year. Many more sustain injuries because of similar incidents on both public and private property.
We understand that a simple slip, trip or fall can have life-changing consequences. It can happen on the pavement, in a shop or at work — a sudden and unexpected accident that could impact you for the rest of your life.
When a council, business or property owner failed to protect you properly, you’re entitled to make a slip, trip and fall claim. Our experienced personal injury solicitors will help you to claim the maximum amount to which you’re entitled.
Causes of Slips, Trips & Falls
A slip, trip or fall can happen almost anywhere. Uneven pavements, poor lighting or wet surfaces are some of the most common reasons. Let’s look at some of the main causes of slips, trips and falls in different places.
Public Places
Footpaths, car parks, playgrounds and other outdoor public places should be maintained by local councils or other public bodies. If they’re not properly maintained, uneven pavements, broken slabs, potholes and hazardous play parks can result in slips, trips and falls.
Workplaces
Falls from height, slips and trips account for 51% of all major injuries at workplaces in Northern Ireland. Construction sites, warehouses, factories, offices and agricultural sites are workplaces where slips, trips and falls often happen. Spillages, obstructions and poor lighting often contribute to workplace accidents.
Shops & Restaurants
When you go to shops, restaurants and other establishments, like cafes, bars, nightclubs, gyms and supermarkets, the business owners have a duty to keep you safe. Unfortunately, wet floors, poor lighting and hazardous obstructions often lead to slips, trips and falls in these indoor public spaces.
Rented Accommodation
Rented accommodation, including homes, hotels, guest houses and B&Bs, are places where we should feel safe. Landlords and business owners have a duty to remove or repair any slip or trip hazards. These are often caused by poorly fitted or maintained flooring, spillages and other obstructions.
Slip, Trip & Fall Injury Claims
Slips, trips and falls can cause a wide variety of injuries, ranging from minor bumps and bruises to life-changing injuries and even fatalities. Common injuries suffered as a result of a slip, trip or fall include:
- Cuts, Lacerations, Bruise & Scarring
- Pulled Muscles & Torn Ligaments
- Broken & Fractured Bones
- Head Injuries
- Back Injuries & Spinal Damage
- Fatalities
Slip, Trip & Fall Claim Eligibility
If you’ve been injured in a slip, trip or fall because somebody failed to put in place the correct maintenance, repair and safety measures to keep you safe, you can make a claim. Who you make a slip, trip or fall injury claim against will depend on your situation.
- Local Council – If your accident happened on council-owned land — such as pavements, steps and walkways — you will claim compensation from the council’s insurance company.
- Employers – If your accident happened at work or at a workplace you will claim compensation from the employer’s insurer.
- Owners of Public Buildings – If you slipped, tripped or fell at a shop, restaurant or other public building, you will claim compensation from the business’ insurance company.
- Landlords – If you were injured in rental accommodation you will claim compensation from the landlord’s insurer.
Slip, Trip & Fall Claim Process
We know that the effects of a slip, trip or fall can last for a long time. With that in mind, we’ve designed a slip, trip and fall claim process that ensures our solicitors take all the strain for you. Here’s what you can expect:
Step 1: Contact Reid Black
The crucial first step is to get in touch. We’ll offer free initial legal advice on your claim.
Step 2: Gathering Information and Evidence
We’ll then start gathering as much evidence as we can to support your claim. This might include medical records and any witness accounts or other evidence from the scene of your accident.
Step 3: Medical Assessment
Next, we’ll arrange for you to be assessed by an independent medical professional. This is to make sure nothing has been overlooked and that any long-term impact of your accident is known.
Step 4: Compensation Negotiations
It’s then time for our experienced solicitors to secure the maximum amount of compensation to which you’re entitled from the other party’s insurance company.
Step 5: Compensation Payout
Finally, we will oversee the process to make sure your compensation is paid to you promptly.
Slip, Trip & Fall Claim Time Limits
The time limit for making a slip, trip or fall claim in Northern Ireland is usually three years from the date of the accident.
18 years old and over – You must claim within three years of the accident if you were an adult when it happened.
Under 18 years old – You must claim by your 21st birthday if you were under 18 when it happened.
The deadlines can be extended in exceptional circumstances, such as if your injuries prevented you from making a claim. But it is always best to contact us to discuss your claim as soon as possible after a slip, trip or fall.
Slip, Trip & Fall Compensation
How much compensation you get for a slip, trip or fall injury will depend on how serious the injury was and any long-term effects. The amount of compensation you are awarded will be split into two categories:
General Damages – Compensation for the pain you suffered and any immediate or long-term injuries caused by your slip, trip or fall.
Special Damages – Compensation for the financial impact of your slip, trip or fall. This covers things like loss of earnings for you or your loved ones, healthcare costs, travel expenses, rehabilitation costs and home adaptations.
