What is the time limit for personal injury claims in Northern Ireland?

The time limit for personal injury claims in Northern Ireland is usually three years from the time the injury was sustained. In cases when either the injury or the negligence isn’t known until later, you must claim within three years of receiving this information.

There are some exceptions to the time limit:

If you were aged under 18 at the time of the injury you must claim before your 21st birthday.
There are no time limits on making a claim when you don’t have the mental capacity to do so.
For accidents on board passenger ships, you must claim within two years of disembarking the ship; for domestic flights, you must claim within two years of landing; and for international flights, you must claim within two years of arriving at your final destination.
The time limits for personal injuries abroad vary between countries, so check the limits for the country in which you sustained your injury as soon as possible.

How long does a personal injury claim take?

A personal injury claim can take anywhere from 4 to 36 months, with most settling in 12 to 18 months. Simpler cases — where the other side admits fault — can be resolved in a matter of months. More complex claims, especially those involving serious injuries or disputed liability, can take longer. That extra time can be a good thing, as it allows for a full understanding of your injury and ensures you receive the compensation you’re truly entitled to.

How many personal injury claims go to court?

Around 2-3% of personal injury claims go to court. We settle the overwhelming majority of personal injury claims without going to court — but we will always keep this option on the table if the negligent party refuses to accept responsibility or agree to an appropriate payout.

Will I need a medical assessment to make a personal injury claim?

Yes, we will arrange for you to have a medical assessment because it is important to make sure that no injuries have been overlooked before making your claim.

Should I accept compensation from the other side's insurer?

No, certainly not before talking to us first. The amount of compensation we will secure through a personal injury claim is almost certain to be more than what the insurer is offering.

What if I was partly responsible for my personal injury?

You can still make a personal injury claim. Your payout will be adjusted to reflect the extent to which you were responsible.

Can I change solicitors during a personal injury claim?

What a fantastic group of people to work with from start to finish. I thoroughly endorse this firm of solicitors to any former service personnel who have suffered hearing loss and/or tinnitus as a result of live firing in pipe ranges in Northern Ireland. They did not take ANY of my compensation in payment, but claim a separate payment directly from the MoD for their work.
